Warm Up Audio Membership

This document and its contents are the intellectual property of Coming Up Roses Creative Pty Ltd (“Company”, “we”, “us”, or “our”).

By purchasing or accessing the Warm Up Audio Membership (“Membership”), you agree to be bound by the following Terms & Conditions, which constitute a legally binding Terms of Service agreement governing your access to and use of the Membership content.

1. Access & Membership Use

Upon purchase, Coming Up Roses Creative Pty Ltd grants you personal, non-transferable, revocable access to the Warm Up Audio Membership for your own individual use only.

Access is delivered digitally via a private podcast feed (RSS link) and may also include access to related digital resources or community spaces, where applicable.

You are responsible for maintaining the confidentiality of your access details, including your private RSS link. Sharing access with others is strictly prohibited.

2. Membership Structure & Billing

The Warm Up Audio Membership is offered as a recurring digital membership with a minimum commitment period, as specified at the time of purchase.

• Payments are billed according to the plan selected at checkout.
• After the minimum commitment period has been fulfilled, the Membership may continue on a recurring basis unless cancelled.
• Pricing, billing frequency, and commitment terms are disclosed prior to purchase and form part of this agreement.

3. Cancellation Policy

You may cancel your Membership at any time after the minimum commitment period has been completed.

• Cancellations must be made before the next billing date to avoid further charges.
• Upon cancellation, access will remain active until the end of the current paid period.
• No partial refunds or prorated credits will be issued for unused time.

4. Refund Policy

Due to the digital nature of this Membership and the immediate access granted upon purchase:

• All payments are final and non-refundable.
• No refunds will be provided under any circumstances, including (but not limited to) unused time, change of mind, or lack of engagement.

By purchasing the Membership, you acknowledge and agree to this no-refund policy.

5. Prohibited Use

You agree that you will not:

• Share, copy, distribute, reproduce, sell, sublicense, or otherwise exploit any part of the Membership content.
• Provide access to your private RSS feed or Membership materials to any third party.
• Use the content to create, promote, or sell competing products, programs, memberships, or podcast-based offerings.
• Plagiarise, adapt, or present the Membership content as your own.

Any unauthorised use constitutes a material breach of these Terms and may result in immediate termination of access and/or legal action.

6. Community Access

Your Membership includes access to a private community space:

• Access is a privilege, not a right, and must be used respectfully.
• We reserve the right to remove any member from community spaces for behaviour that is disruptive, harmful, or inconsistent with community guidelines, without refund.

Removal from a community does not affect your obligation to complete any minimum commitment period.

7. Ownership & Intellectual Property

All Membership content — including audio recordings, transcripts, prompts, frameworks, and associated materials — remains the exclusive property of Coming Up Roses Creative Pty Ltd.

The content is protected under Australian and international copyright, trademark, and intellectual property laws.

8. No Warranty

The Warm Up Audio Membership is provided “as is” and “as available”, without warranties of any kind, express or implied.

We do not guarantee that the Membership will meet your specific needs, achieve particular outcomes, or be uninterrupted or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Coming Up Roses Creative Pty Ltd shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to your use of (or inability to use) the Membership, including loss of profits, business interruption, or data loss.

10. Indemnification

You agree to indemnify and hold harmless Coming Up Roses Creative Pty Ltd, its directors, officers, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses arising out of:

• Your use of the Membership
• Your breach of these Terms
• Any unauthorised use of the content

11. Termination

This agreement remains in effect unless terminated.

We reserve the right to suspend or terminate your access to the Membership immediately if you breach any provision of these Terms. In such cases, no refunds will be issued.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be severed without affecting the validity of the remaining provisions.

13. Reservation of Rights

All rights not expressly granted to you under this agreement are reserved by Coming Up Roses Creative Pty Ltd.

14. Entire Agreement

These Terms constitute the entire agreement between you and Coming Up Roses Creative Pty Ltd regarding the Warm Up Audio Membership and supersede all prior communications, representations, or agreements, whether oral or written.

By purchasing or accessing the Warm Up Audio Membership, you confirm that you have read, understood, and agreed to be bound by these Terms & Conditions.

How do I access the private podcast?

After purchasing, you’ll receive an email with instructions on how to access your private podcast. This email includes a unique RSS feed link, allowing you to add the podcast to your preferred listening app (like Apple Podcasts or Spotify).

You’ll also receive an invite to our private Warm Up Slack channel, where members can connect, reflect, and stay in rhythm together between episodes.

Please be sure to check your inbox — and your spam or promotions folder just in case — if you don’t see the email right away.

Because of the digital nature of this product, all sales are final and we don’t offer refunds.

Why is there a minimum commitment?

The Warm Up is designed as a container you grow inside of, not something to dip into once and move on from. Each season includes a quarterly challenge, giving you a shared focus and enough time to listen, reflect, and integrate the work — both individually and alongside the community.

The 3-month minimum ensures you’re able to fully participate in at least one complete challenge cycle, rather than catching fragments of the experience.

This structure helps us:

• encourage commitment over quick-hit consumption
  
• support better outcomes through consistency and depth
  
• reduce churn, so the community stays grounded and aligned
  
• create a high-integrity membership experience that removes sales pressure and supports focused work and long-term growth.
  

After the initial 3 months, you’re free to continue month-to-month or cancel at any time.
