⚠️Terms & Conditions of Use for "The Warm Up" Podcast

This document and its content are the intellectual property of Coming Up Roses Creative Pty Ltd. By purchasing a subscription to "The Warm Up" podcast, you are agreeing to the terms outlined below, which constitute a Terms of Service agreement outlining the permissions and restrictions regarding the use of the podcast content.

Access and Usage: Upon subscribing, Coming Up Roses Creative Pty Ltd grants you access to "The Warm Up" podcast content for your personal use only. Access is subject to the terms and conditions outlined herein.

• Monthly Subscriptions: If you purchased a monthly subscription, your access will continue on a recurring monthly basis, provided your subscription remains active. You may cancel at any time before the next billing cycle to avoid being charged again.
• 6-Month Paid-in-Full Access: If you purchased the 6-month paid-in-full version, your access will remain active for the full six months. After that period, you will be prompted to either re-purchase another 6-month plan or switch to a monthly subscription to maintain access.

Prohibited Use: You agree not to share, copy, redistribute, or reproduce "The Warm Up" podcast content or any part thereof in any form to any third party without the prior written consent of Coming Up Roses Creative Pty Ltd. You may not use the content in a manner that competes with the business of Coming Up Roses Creative Pty Ltd, including, but not limited to, offering any podcast-based programs or services that directly replicate or utilise the material covered in "The Warm Up", or plagiarising, copying, or distributing the content as your own. Any such unauthorised use or distribution is strictly prohibited and may result in legal action.

Subscription and Payments: By subscribing to "The Warm Up" podcast, you agree to pay the recurring monthly subscription fee specified at the time of enrolment. This fee grants you access to the podcast content for the duration of your active subscription. Your subscription will automatically renew each month unless you cancel before the next billing cycle.

Cancellation Policy: You may cancel your subscription at any time. Upon cancellation, your access to "The Warm Up" podcast will continue until the end of the current billing period. No refunds or prorated adjustments will be issued for cancellations made before the end of a billing cycle.

Refund Policy: All payments are non-refundable. While we strive to ensure customer satisfaction with our podcast, we are unable to provide refunds due to the nature of digital content and the ability to immediately access and use the podcast upon subscription. By subscribing to "The Warm Up", you acknowledge and agree that all payments are final and no refunds will be provided under any circumstances.

Ownership and Copyright: "The Warm Up" podcast, whether in part or whole, is the property of Coming Up Roses Creative Pty Ltd. The podcast is protected by copyright and international copyright treaties, as well as other intellectual property laws and treaties.

No Warranty: "The Warm Up" podcast is provided 'as is', without warranty of any kind, express or implied. Coming Up Roses Creative Pty Ltd does not warrant that the podcast will meet your requirements or that its operation will be uninterrupted or error-free.

Limitation of Liability: In no event shall Coming Up Roses Creative Pty Ltd be liable for any damages (including, without limitation, damages for loss of business profits, business interruption, or loss of business information) arising out of the use of or inability to use "The Warm Up" podcast, even if Coming Up Roses Creative Pty Ltd has been advised of the possibility of such damages.

Indemnification: You agree to indemnify and hold harmless Coming Up Roses Creative Pty Ltd and its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your use of "The Warm Up" podcast or your breach of any provision of this agreement.

Termination: This agreement is effective until terminated. Coming Up Roses Creative Pty Ltd reserves the right to terminate access to "The Warm Up" podcast at its discretion if you fail to comply with any provision of these terms and conditions. If your subscription is cancelled or terminated, access to "The Warm Up" podcast will be revoked at the end of the current billing cycle.

Severability: If any provision of these terms and conditions is found to be invalid or unenforceable under applicable law, such provision will be deleted without affecting the remaining provisions herein.

Reservation of Rights: All rights not expressly granted herein are reserved to Coming Up Roses Creative Pty Ltd.

By subscribing to and using "The Warm Up" podcast, you acknowledge that you have read and understood this agreement and agree to be bound by its terms and conditions. You also agree that this agreement is the complete and exclusive statement of the agreement between you and Coming Up Roses Creative Pty Ltd, which supersedes any proposal or prior agreement, oral or written, and any other communication between you and Coming Up Roses Creative Pty Ltd relating to the subject of this agreement.

After purchasing, you will receive an email with instructions on how to access your private podcast. This email will include a unique RSS feed link, allowing you to add the podcast to your preferred listening app. Be sure to check your inbox (and spam folder, just in case).

Because of the digital nature of this product, there are no refunds.
